MEDICARE REPORTING

Medicare beneficiaries must comply with Section 111 of the Medicare, Medicaid, and SCHIP Extension Act of 2007. This legislation mandates that insurers report specific information to the Centers for Medicare and Medicaid Services (CMS) regarding any tort claims involving an alleged tortfeasor with liability insurance, no-fault insurance, or Workers' Compensation (WC).


**Reporting Threshold:** Settlements exceeding $750 related to physical trauma-based claims must be reported.


To fulfill this requirement, the following steps must be taken:


1. Report the case through the Medicare Secondary Payer Recovery Portal (MSPRP) or

2. Contact the Benefits Coordination & Recovery Center (BCRC) for assistance.
